Copyright and takedown policy

How to tell us that something made or stored with Cralio infringes your copyright, what we do about it, and how the account holder can answer. This policy sits under Terms §14 and the acceptable use policy.

Where to send a notice

Write to info@cralio.app with “Copyright notice” in the subject. The mailbox is read by a person. Post goes to CRALIO LLC, 5830 E 2nd St, Ste 7000 #38271, Casper, WY 82609, United States.

We have not yet registered a designated agent with the U.S. Copyright Office. When we do, the agent’s name and address will appear here. Until then this address takes every notice and counter-notice.

What a notice needs

So that we can find the file and act on it, include:

  • the work you say is infringed, or a list of them;
  • the material you say infringes it, with enough to find it: where you saw it, what is in it, and anything on it that identifies the account or the job;
  • your name, postal address, telephone number and email;
  • a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
  • a statement that the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner;
  • your physical or electronic signature.

A notice that is knowingly false can make the sender liable for the damage it causes.

What we do with it

We pass the complaint to the account holder and ask them to delete the file. Where the complaint is credible we freeze the account: it can no longer buy or submit work, and nothing on it can be deleted while the case is open. We tell you what we did. We act on what we are told; we do not review what customers upload looking for problems.

Counter-notice

If you are the account holder and believe the material was removed or frozen by mistake or because it was misidentified, write to the same address with: the material and where it was before; a statement under penalty of perjury that you believe in good faith it was removed or disabled by mistake or misidentification; your name, address and telephone number; a statement that you consent to the jurisdiction of the federal court for your address (or, outside the United States, any judicial district in which we may be found) and will accept service from the person who sent the notice; and your signature. We send a copy to the person who complained.

Repeat infringers

An account that is the subject of repeated credible notices is closed, not only frozen. Closing it ends the account under the terms; we decide case by case what counts as repeated, and a counter-notice that holds up does not count against the account.
